Appellees concede the correctness of appellant’s statement of the facts of the case, and we therefore adopt it:

“This is a mandamus proceeding brought in the superior court of Maricopa eounty by the appellees for the purpose of compelling the appellant, the eounty attorney of said Maricopa eounty, to bring a quo warranto action against W. M. Scott, F. D. Rowell, and G. W.
