HOOD, District Judge.

James Keith Malcum, (“Petitioner”), presently confined at the Brooks Correctional Facility in Muskegon Heights, Michigan, has filed a petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254, both pro se, and with the assistance of attorney Jillvonnie M. Flowers.
