I. FACTS AND BACKGROUND

Before me is plaintiff Gary Uphill’s application for an award of attorney’s fees pursuant to the Equal Access to Justice Act (“EAJA”), 28 U.S.C. § 2412. Plaintiff brought this action under 42 U.S.C. § 405(g) challenging the partially unfavorable decision of defendant Jo Anne Barn-hart, Commissioner of the Social Security Administration (“the Commissioner”), on his application for disability benefits under the Social Security Act.
