This action arose out of a collision between two automobiles at the intersection of state aid road No. 1 and trunk highway No. 27 in Douglas county on March 1, 1951, at 1 p. m. Emil P. Hierl, owner and driver of one of the cars, first brought this action against Homer C. McClure, owner and driver of the other car, for personal injuries and property damage as the result. McClure answered, interposing a general denial and allegations of contributory negligence.
