Defendant having been found guilty of the crime of robbery in the first degree appeals from the judgment of conviction.

Ir the early hours of August 14, 1960, two masked men appeared at the Auditorium Hotel in the city of St. Paul and at the point of a gun took from the night clerk $18 in cash. In making their escape, one of the robbers, who was carrying a sawed-off shotgun, accidentally discharged it in the stairway leading from the hotel.
