After arrest upon a warrant and examination before a justice of the peace, petitioner John Bourne was charged in an information dated August 29, 1939, with the crime of incest. The information states that on the 19th day of .December, 1935, Bourne had incestuous relationship with his stepdaughter, Hazel Marsh, in violation of Act No. 328, § 333, Pub. Acts 1931 (Comp. Laws Supp. 1940, § 17115-333, Stat. Ann. § 28.565). Bourne pleaded guilty and received a 10-year sentence.
