The amended petition filed in this action alleges that on the 24th day of November, 1924, the district court of McCurtain county entered judgment finding indebtedness of said county amounting to $66,000. That funds arising from the funding bond issue came into the possession of one A. J. Waldock, and that Waldock deposited said money in the defendant bank to his credit as trustee. That thereafter R.
