This is an action in conversion against the defendant bank located at Portland, Oregon, for participation in an alleged breach of trust. Defendant, Russell W. Robertson, against whom a default judgment has been taken, was clerk of school district No. 106 in Clackamas County, Oregon. On July 14, 1924, he opened an account with the defendant "bank in the name of “School District No. 106, Bus-sell W.
