¶[1 The State of Washington appeals the trial court’s dismissal with prejudice of its charge against Thomas Chad O’Meara for unlawful use of drug paraphernalia. The State contends that it had asserted a prima facie case; therefore, granting the juvenile defendant’s pretrial motion for dismissal was error. Holding that the trial court’s dismissal with prejudice was error, we *640reverse the trial court’s order and remand for further proceedings.
