MEMORANDUM OF DECISION AND ORDER

McNAMEE, District Judge.

Pending before this Court and considered herein is the Intervenor-defendant’s motion to dismiss for lack of standing treated as a motion for summary judgment under Fed. R. Civ. Pro. 56, and the Federal Defendant’s motion to dismiss pursuant to Fed. R. Civ. Pro. 12(b)(1), for lack of subject matter juris diction, and 12(b)(6), for failure to state a claim upon which relief may be granted.
