MEMORANDUM OPINION

LEON, District Judge.

The City of Tacoma (“the City”) has brought this action against the National Marine Fisheries Service (“NMFS”) seeking judicial review of a Biological Opinion (“BiOp”) issued by the NMFS pursuant to the Endangered Species Act (“ESA”), 16 U.S.C. § 1531 (2005), and in relation to a licensing order granted by the Federal Energy Regulatory Commission (“FERC” or “the Commission”) for continued operation of a federally regulated hydroelectric power generation facility. 16 U.S.C. §§ 791-828 (2005).
