The defendants, Westwood and the State Engineer, appeal from the decision of the district court which refused to approve an application by the defendant Westwood to the State Engineer's Office to appropriate .25 cubic feet per second of water. The state engineer approved this application over the protest of plaintiff Mrs. Riordan who is the owner of the lands on which the applicant proposes to divert and appropriate the waters in question.
