This is an action in equity to enjoin defendant from operating certain wells situated in an alleged artesian district in the northwest part of Salt Lake City, Utah.

In order to unravel certain complications which have developed during the progress of the cause, it is necessary to briefly summarize in chronological order the various moves *281made by the parties litigant and orders of the court in respect thereto since the commencement of the action.
