This case comes before the Court on the parties’ cross motions for summary judgment *385following a remand from the United States Court of Appeals for the Federal Circuit. Plaintiffs are operators of coal mining operations. Pursuant to Title IV of the Surface Mining Control and Reclamation Act of 1977 (“SMCRA”) and its implementing regulations, plaintiffs paid a reclamation fee on coal, some of which was exported to foreign customers.
