OPINION

ROBINSON, Judge:

This military pay case is before the court on defendant’s motion to dismiss or in the alternative for summary judgment, and plaintiff’s cross-motion for summary judgment. Briefing of the issues is complete. Oral argument was held on November 8, 1989. Thereafter, by agreement of the parties, the case was stayed by order of the court for an indefinite period to permit a final determination and issuance of a judg*10ment in Tilley v. United States, 19 Cl.Ct. 33 (1989), a similar case which was also pending before this court. That stay order was lifted by a subsequent order of…
