RIPPEY, District Judge.

Harry D. Lathrop, one of the plaintiffs, is a citizen and resident of Chicago, 111.; Lathrop-Paulson Company is an Illinois corporation having its principal place of business in Chicago; and the defendant Rice & Adams Corporation is a New York corporation with its principal place of business in Tonawanda, N. Y.

This is an action at law to recover royalties which plaintiffs claim are "due to them under a written license agreement duly executed by the parties on September 13, 1929. Jury trial was duly waived and the case was tried before the court without a jury.
