MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

This action arises out of the termination of plaintiff Hollis A. Talamine’s disability benefits. Talamine initially filed this action in the Circuit Court of Cook County against defendant Unum Life Insurance Company of America (“Unum”), alleging breach of contract and violation of § 154.6 of the Illinois Insurance Code, Ill.Rev.Stat. ch. 73, par. 766.6.
