Action by George Russell for injuries sustained when he fell on a public sidewalk in Minneapolis. The jury returned a verdict in his favor for $1,200. This is an appeal from the judgment entered thereon.

At the trial and on appeal here defendant contends that (1) the notice of claim which plaintiff served upon it pursuant to Minn. St. 465.09 1 did not describe the place of the accident with sufficient ac curacy to make it valid; and (2) because thereof there was a material variance between the notice of claim and proof as to the place of accident.
