This appeal involves an action by the plaintiff, Elva Mae Brittain, for personal injuries suffered on April 8, 1954, when she allegedly tripped and fell because of a depression in a public sidewalk of the defendant city of Minneapolis. It is the claim of the plaintiff that the depression of the sidewalk had created an abrupt change in the level of about one and one-half to two inches between the sidewalk and an adjacent paved driveway crossing the boulevard and leading to the property owned by the defendant Standard Oil Company, and occupied by the defendant Wayne C.
