Appellant sued appellee to recover $58, the balance of the purchase money alleged to be due for a refrigerator sold by the former to the latter. Appellee answered that he was a butcher and bought the refrigerator upon a special warranty that it would be delivered in good condition and that it would not leak, for the purpose of keeping his meat in good condition; that there was a breach of warranty in that the refrigerator was not delivered in good condition, but leaked and was wholly worthless; that he had paid $28 of the purchase price, and that he lost, by reason of…
