This case presents error from the district court of Hughes county, in which on March 1, 1909, the defendant in error as plaintiff filed its petition in which it prayed for judgment against the defendant, plaintiff in error here, for the- sum of $1,568.21 for and on account of certain goods, wares, and merchandise sold and delivered to him at his instance and request. To this petition defendant filed answer in which he admitted having purchased the goods from the plaintiff, but set up that the same was machinery for a gin, and was purchased on a contract containing a warranty.
