Coppla and one Rochlin were charged in count one of an information with having violated Penal Code section 337a, subdivision 3, in that they did hold certain memo*767randa and papers which represented and referred to moneys bet on the result of horse races, and in count two with having violated Penal Code section 337a, subdivision 1, in that they did engage in pool selling and bookmaking on the result of a horse race. Both counts were based on the same facts. The court, without a jury, found Coppla not guilty of the offense charged in count one and guilty of the offense charged in count two.…
