VALLÉE, J.

By information defendant was accused of the murder of Raymond Whiteside. In a non jury trial the court found him guilty of voluntary manslaughter and sentenced him to state prison. He appeals from the judgment.

Defendant’s contention is that the finding of guilt of manslaughter is unsupported by the evidence and is contrary to law. He asserts the evidence, as a matter of fact and law, is insufficient to prove manslaughter; to the contrary, the evidence establishes a justifiable homicide under Penal Code, section 197.
