The plaintiff, a passenger, was hurt on an escalator at the Andrew Square station of the Boston *22Elevated Railway Company, and brings this action of tort, in which the Metropolitan Transit Authority has been substituted as party defendant. St. 1947, c. 544, § 20, as amended by St. 1948, c. 147, § 1. There was a. verdict for the plaintiff. The defendant’s exceptions are to the denial of its motion for a directed verdict in its favor and to the denial of its motion to enter a verdict for the defendant under leave reserved.
