The plaintiff brings this action of tort, alleging that he was injured by an automobile which was negligently “operated ... by and under the control of a person for whose conduct the defendant was legally responsible.” G. L. (Ter. Ed.) c. 231, § 85A (quoted in footnote1). Absence of such responsibility and contributory negligence were set up in the answer, which also contained, a general denial. The jury returned a verdict for the plaintiff.
