OPINION OF THE COURT

Silverman, J.

Defendant appeals from a judgment of the Supreme Court, Bronx County, convicting him on a jury verdict of perjury in the third degree (Penal Law, § 210.05) and sentencing him to a three-year term of probation thereon.

Defendant, an attorney, was convicted of perjury because of his having verified a false bill of particulars in a personal injury action in which the plaintiff, Biggica, was his client. There is no dispute as to the falsity of this bill of particulars but conviction requires that it be shown that the defendant "intentionally makes a false statement…
