FINDINGS OF FACT AND CONCLUSIONS OF LAW

The Chicago Truck Drivers, Helpers and Warehouse Workers Union (Independent) Health and Welfare Fund and the Chicago Truck Drivers, Helpers and Warehouse Workers Union (Independent) Pension Fund (“Funds”) filed claims herein. They moved for estimation of their claims for the purpose of counting their vote against the debtor’s proposed Plan of Reorganization, pursuant to Fed.R.Bankr.P. 3018(a).
