GRONER, District Judge.

These proceedings have been brought by 46 libelants against the Bank Line, Limited, in personam, as owner of the British steamship Poleric, to recover for loss of or damage to cargo shipped upon the vessel at Calcutta in September and October, 1920, to be delivered at Boston and New York.

The vessel put into the Azores during heavy weather, and, after a delay of six weeks, making temporary repairs, was about to sail, when fire broke out in her cargo. When the fire was extinguished, the vessel proceeded to Rotterdam on the advice of all concerned in ship and cargo, and…
