Bernice Bays, individually and as personal representative of the estate of her husband, William Bays, brought this wrongful death action against Harvey DeWitt, M.D., and St. Luke's Hospital d/b/a Valley Hospital (Valley General), alleging medical negligence and failure to secure informed consent for additional treatment. Before trial, the court dismissed the informed consent claim against Valley General as a matter of law. At the close of evidence, the court dismissed the informed consent claim against Dr. DeWitt.
