This was an action of assumpsit brought by Catherine Hannin in tbe Circuit Court for tbe County of Van Burén, against Henry Hammond, to recover damages for tbe breach of a contract to sell and convey to tbe plaintiff a parcel of land. The material facts in this case are as follows: On September 10, 1864, Hammond contracted to sell to Hannin an eighty acre lot in the County of Yan Burén, for the sum of five hundred dollars, of which one hundred and twenty dollars were to be paid down, and the balance in subsequent installments. The contract was in writing, and was signed and sealed on behalf of Hannin, by Bartly Hannin, her husband, who had oral authority for the purpose.
