This action was instituted by plaintiff in error, William Boorigie, as plaintiff, in the district court of Cherokee county against the defendant in error, Abdo Boorigie.

The parties will be referred to as plaintiff and defendant, as they appeared in the trial court.

Plaintiff alleged, among other things, in his amended petition, that the defendant and the plaintiff had been theretofore engaged as partners in carrying on a general mercantile business and wholesale and retail grain and feed business and the buying and selling of live stock and real estate at Hulbert, Okia..…
