This was a proceeding under the Workmen’s Compensation act to recover compensation on account of the accidental death of Henry Hunley while employed by plaintiff in error. The board of arbitrators appointed under the act found againsCthe plaintiff in error. On review before the Industrial Board it was stipulated by the parties, and the board so found, that Hunley and plaintiff in error were operating under and subject to the provisions of the Workmen’s Compensation act, and that the accident resulting in Hunley’s death arose out of and in the course of his employment.
