Brainard brought suit in the district court of Humboldt County against the petitioners herein, alleging in his complaint that the Jaca Commercial Company, a corporation, being indebted to the.First National Bank of Boise, Idaho, in the sum of $59,000 on or about the — day of October, 1920, made, executed, and delivered to said bank its promissory note for the amount stated and delivered to the bank as collateral security for the payment of said note, sundry notes aggregating the sum of $96,000; that…
