THE COURT.

From the judgment which followed the granting of defendants’ motion for a nonsuit, plaintiffs appeal.

The averments of plaintiffs’ complaint essential to this consideration are the following: Lola Pox (wife of plaintiff, Henry Pox), her brother, Clarence C. Hall, and her sister, Rosa E. Patehett, defendants herein, were the owners in fee as tenants in common, each seised of an undivided one-third of a certain ranch in Sonoma County.
