Nichan Martin was convicted of murder in the first degree in the superior court of Yavapai county before a jury, on March 29, 1920, the jury fixing the penalty at death. The court sentenced him to death on April 13, 1920. The day for the execution of the death sentence was fixed as Friday, June 25, 1920. Thereafter he appealed from the judgment of conviction to this court. On April 4, 1921, the judgment of conviction was affirmed by this court, and he filed a petition for rehearing, which was denied on May 4, 1921.
