MEMORANDUM ENTRY DISCUSSING SUMMARY JUDGMENT IN FAVOR OF DEFENDANT CITY OF COLUMBUS, INDIANA

The essence of this matter is whether Plaintiffs are covered by the Fair Labor Standards Act (the “Act” or “FLSA”), 29 U.S.C.A. §§ 201, et seq. (West 1965 & Supp. 1991). Under the Act, public fire fighting employees are entitled to premium compensation, at the rate of one and one-half times their regular rate, for time worked in excess of fifty-three hours per week.
