This adversary proceeding is before the Court on several matters as follows: (1) Plaintiffs motion for summary judgment; (2) Plaintiffs motion to compel discovery; and (3) Plaintiffs request for oral argument. 1 After reviewing the record and evidence presented, and after considering the argument presented in the briefs, the Court concludes as follows.
