The Plaintiff, NBA Properties, Inc. (herein “NBAP”), by motion seeks summary judgment on the issue of discharge-ability of its claim against debtor’s estate. The Defendant, Frederick Erskine Moir (herein “Defendant”), contends that there are genuine issues of material fact which render summary judgment inappropriate. The Plaintiff asserts that the Defendant’s debt for a pre-petition judgment for conversion is non-dischargeable under 11 U.S.C. § 523(a)(6).
