MEMORANDUM AND ORDER

This is a diversity action for the allegedly wrongful death of Jennifer Shannon, who was killed after she was struck by a hostler truck operated by defendant Arrow Vogel, an employee of defendant Pacific Rail Services, L.L.C. (“Pacific Rail”). The matter is presently before the court on defendant Pacific Rail’s motion for summary judgment (doc. 75). Also before the court is defendant Arrow Vogel’s motion for reconsideration of the court’s August 18, 1999 order imposing sanctions (doc. 94).
