I. Introduction
The plaintiffs in this action (“Plaintiffs”) include five entities (the “EMI Labels”) engaged, inter alia, in the business of producing and distributing sound recordings in the United States. In their complaint, the Plaintiffs contend that defendant MP3tunes, LLC (“MP3tunes”) has infringed their music copyrights through the operation of two web sites, www.sideload.com and www.mp3tunes. com.
