The Department of Energy (DOE) appeals from two orders of the District Court for the Western District of Louisiana.1 The first order denied DOE’s motions to dismiss the complaint and to vacate intervention orders. The second order granted the summary judgment motion of the State of Louisiana (plaintiff-appellee) and Texaco, Inc. and Louisiana Land and Exploration Company (plaintiffs-intervenors-appellees).
