The present hill was filed to remove .the defendant from the office of justice of the peace, claimed by him, on the ground that he was an intruder without authority of laiv, and that the complainant was the real incumbent of the office. The bill was met by a demurrer, which was sustained by the chancellor. Thereupon an *232appeal was prayed and prosecuted to this court.
