1. INTRODUCTION

The pro se plaintiff in this action, Mitchell Swartz (“Swartz”), brings a multi-count intellectual property action against the Schering-Plough Corporation (“Schering”), Plough U.S.A. (“Plough”), and Schering-Plough Healthcare Products (“Schering Healthcare”) (collectively, the “Schering Defendants”). The gravamen of Swartz’ complaint is that the Schering Defendants expropriated Swartz’ idea for a “dual-protection” product to screen children and adults from harmful ultraviolet sunlight as well as insects.
