The prosecution in this case- was upon an indictment containing two counts.

The first count charged, that Robert Shinn and another person, whose name .was to the grand jury unknown, “ on the 15th day of August, A. D. 1878, at,” etc., “ did then and there unlawfully, forcibly and feloniously, take from the person of Ithamar McCarty, by violence, three ten-dollar Rational bank bills, of the value of ten dollars each, and of the aggregate value of thirty dollars, upon a Rational bank and Rational banks to the said grand jury unknown, of the personal property, goods and moneys of Jasper R.…
