indictment of appellant for grand larceny. Conviction; new trial denied; sentence, and appeal.

The reasons assigned by 'appellant in his motion for ■■a new trial were as follows :

1. Error of law in the court below, occurring at the trial, in overruling defendant’s challenge for cause to John Hamilton, who was called as a juror, to which proper exceptions were taken;

2. Error of law in the court below, in giving to the jury trying the cause, of its own motion, the instructions numbered respectively, five, six, seven, eight, ten, eleven and twelve, to the giving of each of which the defendant…
