[1.] The motion to arrest the judgment, first demands attention, in the consideration of this cause. The ground of the motion, is that the indictment charges two separate and distinct offences jn one and the same count, to wit: robbery by force, *314and robbery by intimidation. It contains but one count, and in that the defendants are thus charged: “For that the said Jesse T.
