MEMORANDUM OPINION

(December 13, 2001)

Before the Court is a Motion for Summary Judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure, and a Supplemental Memorandum in Support of Defendant’s Motion to Dismiss, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. Both motions were filed by Defendant Caneel Bay, Inc. (“Caneel Bay”). Because federal law does not preempt the Virgin Islands wrongful discharge statute, Caneel Bay’s Motion to Dismiss must be DENIED.
