Joel Gonzalez appeals the order of the District Court of the Virgin Islands, granting summary judgment against him. We hold that the District Court erred in concluding that a prior holding by an Administrative Law Judge (ALJ) in Gonzalez’s unemployment compensation proceedings precluded litigation of Gonzalez’s claim that he was wrongfully discharged. Accordingly, we will vacate the District Court’s grant of summary judgment with respect to Gonzalez’s wrongful discharge claim and remand this claim to the District Court.
