In the present judicial review action, Babak Najafi, Petitioner, asks this Court to determine that his driver’s license should not have been suspended for his refusal to submit to a chemical breath test, because he allegedly was not given a reasonable opportunity to consult with counsel prior to making a decision of whether to submit to the test and because, according to Najafi, he never affirmatively refused to take the *166test.
