Once again we have been called to review the decision of an administrative law judge that suspended a driver’s license for refusal to submit to a chemical breath test, following a hear ing, pursuant to Section 16-205. l(f)(8)(i) of the Transportation Article. 1 The Circuit Court for Cecil County, in a similar exercise of judicial review, reversed the suspension, however, having determined that the police officer, who requested the breath test, did not possess reasonable grounds to detain Dana Eric Carpenter, Respondent.
